FCC
The FCC’s Wireline Competition Bureau (Bureau) granted the petition of Time Warner Cable Inc. (TWC) for preemption of the jurisdiction of the North Carolina Rural Electrification Authority (NCREA) with respect to the arbitration of an interconnection agreement between TWC’s telecommunications carrier subsidiary, Time Warner Cable Information Services (North Carolina), LLC (TWCIS) and Star Telephone Membership Corporation (Star), an ILEC.
The Bureau concluded that the NCREA failed to act to carry out its responsibility under §252 of the Communications Act within the statutory deadline. Accordingly, the FCC will assume the NCREA’s jurisdiction over the interconnection arbitration proceeding between TWCIS and Star in North Carolina. TWCIS may now petition the FCC for arbitration of the interconnection disputes that were the subject of the NCREA proceeding. Read the Order here
New Mexico
The Commission has extended the deadline for parties to file compromise positions in its proceeding considering changes to the State Rural Universal Service Fund (SRUSF) rules. The new due date is November 22, 2013. Originally, workshop participants were asked to submit areas of agreement and disagreement concerning the proposed rule changes by November 1, 2013. However, the participants requested additional time to reconcile their positions on key topics addressed during the workshop sessions. They indicated that the additional time will make it more likely that compromise positions can be reached and reported to the Commission.
