TMI Net Neutrality

The US Court of Appeals for the District of Columbia Circuit has denied motions for stay of the FCC’s Open Internet/Net Neutrality Order. This means that the FCC’s new Open Internet rules will go into effect tomorrow, June 12, 2015.

 

The Court found the Petitioners, which included the United States Telecom Association, the National Cable & Telecommunications Association, CTIA – The Wireless Association, AT&T Inc., the American Cable Association, CenturyLink, and the Wireless Internet Service Providers Association, had not satisfied the “stringent requirements for a stay pending court review.” However, the Court did agree to consider the appeals on an expedited basis. It directed parties to file a proposed briefing schedule within 14 days.

 

IFCC Chairman Wheelern response to the Court’s action, FCC Chairman Tom Wheeler issued the following statement:

“This is a huge victory for Internet consumers and innovators! Starting Friday, there will be a referee on the field to keep the Internet fast, fair and open. Blocking, throttling, pay-for-priority fast lanes and other efforts to come between consumers and the Internet are now things of the past. The rules also give broadband providers the certainty and economic incentive to build fast and competitive broadband networks.”

 

Earlier this year, the FCC also denied petitions to stay its Order.
