FCC

         International Circuit Capacity Report

The FCC released the first U.S. International Circuit Capacity Report, providing information on the U.S. international submarine cable landscape. The report presents circuit capacity data submitted by U.S. facilities-based common carriers, non-common carrier satellite operators, cable landing licensees, and U.S. international carriers that owned or leased capacity on a submarine cable between the United States and any foreign point, as of December 31, 2014. The FCC noted that its new reporting requirements have “substantially improved” its data collection and that 94.6% of the total available capacity on all U.S. international submarine cables is now captured, compared to 7.1% under the previous reporting requirements.

Notable highlights from the U.S. International Circuit Capacity Report include:

  • Submarine cable capacity has grown around 36% per year for 2007-2014 and is expected to grow around 29% for 2014-2016.
  • As of December 31, 2014, the top eight foreign landing points (in descending order) for U.S. international submarine cables are Colombia, Japan, the United Kingdom, Panama, Brazil, Venezuela, Mexico, and Australia.
  • The distribution of U.S. international cable landing points varies across the Americas, Atlantic, and Pacific regions.
  • Of the Americas, Atlantic, and Pacific regions, the Atlantic region has the largest fraction of non-activated capacity in 2014.

          SADC (aka Business Data Services Data Collection)

The FCC released another list of additional parties that have signed an acknowledgement of confidentiality (AOC) and that seek to review the data gathered through the FCC’s special access data collection (SADC). The list includes persons that signed AOCs since the FCC’s last Public Notices. Companies that submitted confidential or highly confidential information in response to the SADC have until January 20, 2016, to object to the disclosure of their data and information to any of the parties on the list.

         Release of NRUF Data

The FCC announced that the United States Department of Justice, Antitrust Division has requested access to information contained in the June 2013 Numbering Resource Utilization and Forecast (NRUF) reports (and any updates) filed by wireless telecommunications carriers, by carrier and by rate center, and to disaggregated, carrier-specific local number portability (LNP) data related to wireless telecommunications carriers, by carrier and by rate center, from June 2013 forward. The information is being requested as part of DOJ’s investigation of the proposed acquisition by Atlantic Tele-Network, Inc. of Caribbean Asset Holdings, LLC. The DOJ described how it will protect the confidentiality of sensitive information contained in the reports and prevent competitively sensitive information from being shared among competitors.   Affected parties have until January 22, 2016 to oppose disclosure of NRUF and LNP data to DOJ. If the FCC receives no oppositions by that time it will disclose the information.

FirstNet

The First Responder Network Authority (FirstNet) issued its Request for Proposals (RFP) for the deployment of the nationwide public safety broadband network, marking a major step forward in FirstNet’s efforts to modernize communications for first responders and other public safety personnel across the U.S. Proposals to the RFP will be due April 29, 2016, with questions and capability statements due February 12 and March 17, respectively. FirstNet will review and consider all responses submitted and anticipates making an award in the fourth quarter of 2016.

FirstNet will conduct a public webinar on Friday, January 15 from 1 p.m. to 3 p.m. EST to review key RFP elements with interested parties, including states, tribes, territories, public safety stakeholders, and market participants. The webinar will be available on FirstNet’s website, with a link to the event webpage from the FirstNet’s homepage.
